Your notice must include the following information to be valid under the DMCA (17 U.S.C. § 512(c)(3)):

  • Your Contact Information: Your name, address, telephone number, and email address.
  • Identification of the copyrighted work: A clear description of the copyrighted work that you claim has been infringed, or if multiple works are involved, a representative list of such works.
  • Identification of the infringing material: A description of the material you claim is infringing and that you want removed or access disabled, including the specific URL(s) or location(s) where the material is located on ScarletAppiOS.
  • A statement of good faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement of accuracy: A statement, made under penalty of perjury, that the information provided in your notice is accurate, and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
  • Signature: Your electronic or physical signature or the signature of a person authorized to act on behalf of the copyright owner.

2. How to Submit a DMCA Notice

Upon receiving a valid DMCA notice, we will investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.

3. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification. To be valid, the counter-notification must include the following information:

  • Your Contact Information: Your name, address, and telephone number.
  • Identification of the material: A description of the material that was removed or to which access was disabled, and the location where it appeared before it was removed or disabled.
  • A statement of good faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which ScarletAppiOS may be found, and that you will accept service of process from the person who provided the original DMCA notice or their agent.
  • Signature: Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a lawsuit within 10-14 business days of receiving the counter-notification, we may restore the material in question.

4. Repeat Infringers

ScarletAppiOS reserves the right to terminate user accounts or restrict access for users who are deemed to be repeat infringers. If a user receives multiple DMCA complaints and fails to comply with copyright law, we may take additional steps to prevent further violations.

5. Misrepresentation

Please be aware that under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys’ fees. If you are unsure whether the material infringes on your copyright, we recommend seeking legal advice before submitting a DMCA notice.
